URGENT! Which tax form for late payment fine?
URGENT! Which tax form for late payment fine?
We are leaving Spain on June 10 and I just now got a registered letter saying there is a fine for late payment of the non-resident tax (form 210) for 2016. I want to pay it online (have electronic certificate) but I do not know which form to use. Do I use 210 again? Or is there another form to use for late payments?
Many thanks in advance for your help.

The letter from the tax office should have included a page entitled:
MODELO PARA EFECTUAR ALEGACIONES EN EL PROCEDIMIENTO SANCIONADOR
which you must complete, sign and return putting a check mark against the paragraph that says 'Que, estando de acuerdo con la propuesta contenida en el citado escrito, no presento ninguna alegación (assuming you are accepting the fine and do not wish to challenge it). You can do this online with your digital certificate.
You will then get another letter which includes two copies of a Modelo 002 showing the amount of the fine and how it is calculated and with barcodes for scanning by the bank to which you take the forms for payment. Once it is issued you will find this under 'Mis expedientes' on the AEAT web site. You can download and print it out without waiting for it to arrive in the post.
It is done this way in two stages because you get a discount if you accept the fine and another discount if you pay it within the due time which is explained in the section IMPOSICIÓN DE SANCIÓN.
I don't think you can make this payment online.

Re: URGENT! Which tax form for late payment fine?
Wonderful! I did sign the letter online that states 'Que, estando de acuerdo con la propuesta contenida en el citado escrito, no presento ninguna alegación'. Just to be sure, I will also print and mail it. I was trying to accomplish this before leaving Spain but now I see that I must wait for another letter. Thanks ever so much. I've spent hours trying to find which form to pay this online -- unsuccessfully!

Re: URGENT! Which tax form for late payment fine?
Don't forget that you should be able to access the second notification with your digital certificate on the AEAT web site under 'Sede Electrònica'. Once you sign for the Modelo 002 you only have just over a month to pay without losing the discount for prompt payment.
If you have a friend in Spain in whom you have complete confidence you could perhaps leave the amount of the fine with that person then email the two copies of the form 002 so that it can be paid on time. It is just a matter of taking both copies to a bank and retaining the receipted copy as proof of payment.
The barcode will not work if the deadline for payment has already been passed when the forms are presented. You would then be sent another Modelo 002 but without the discount for prompt payment.

Very clear and interesting. I believe it can be paid via our Caixa account once I have modelo 002. Just in case I will leave the money with our lawyer who can pay it. thanks ever so much.

Re: URGENT! Which tax form for late payment fine?
This thread has come with perfect timing for me...I have just received the same letter (due to late return for 2016 renta) for my other half.
It seems within my limited abilities to do online, and we have fresh Digital Certificates, but what exactly should go on the first form?
the name and NIF (no option for an NIE which perhaps shows how few non-Spanish get involved in taxation...) but "como"? and "de"?....then "NIF" again?....
Clarifiction would be very helpful gurus!

NIF and NIE are the same thing, just enter your NIE.
The headings to which you refer are there in the case that you are being represented by a lawyer or gestor. Under 'Como' put 'interesado/sujeto pasivo' and leave 'de' and the second NIF number blank.
On the last page put a line through 'representante'

You can send this form without a digital certificate but what you would not be able to do is access the follow up payment form 002 from the Sede Electrónica.

Did you manage to send your form or do you want me to take you further into the procedure?

Re: URGENT! Which tax form for late payment fine?
I downloaded the form, filled it in and added a signature, but gave up on trying to send it. I find the Aet website very difficult to navigate. I have filled the form received by post with a wonderful piece of technology known as a ballpoint, and it will be going in the post later today.....

A very generous offer beachcomber, but I could not impose.....I fear it is too late in my life to be able to do more than basic stuff on computers, and when I try beyond my abilities it makes me feel old and incompetent, not things I am comfy with.

Well, most procedures on the AEAT web site certainly cannot be described as intuitive so no shame there especially as one has to struggle with a foreign language as well and the fact that this section does not respond to attempts to select the English option.
