BEING MADE RESPONSIBLE FOR PLANTER

Just asking for a friend. They had a meeting the other day and owners have been told that they will now be responsible for the upkeep and insurance of the planters on the outside wall of their flats. Is this possible bearing in mind it has always been the responsibility of the community!

She has a description of what she owns ie the flat and the balcony but it does not include the planter on the outside of the wall!

I don't know about the legal implications of this but my next door neighbour had a number of planters on the ledge outside his window (we are 4 floors up) they were blown off one day in a strong wind and crashed to the ground narrowly missing a couple of people, the potential danger was frightening, he was told by the building administrator that they would have to be insured in future !!

Well for the 25 years that they have had the planters and the community have repaired them and also planted flowers in them, but now they are saying that the owner of the flats are responsible now for the planters!

When my friend put plants in hers the community pulled them out and planted their own!

Not sure what the law is on this.

I would have thought that it would not be a law, but a decision by the urbanisation committee, which surely all owners would have voted on?

The simplest solution to resolve the problem would be to remove the planters. No planter, no problem and nothing to insure but household insurance may well cover this if declared.

Well it is not clear who owns it. If she removes it and then they say it belongs to the community again she will have to put it back.

In the UK the outside of flats are the responsibility of the freeholders, not the leaseholders. I do not know what the law is in Spain, I would imagine the same as it is the community who paint the outside.

Then removing it should answer the question.

Yes but they are saying they are now not the owners and that the leaseholder/commonholder is responsible for the upkeep and insurance. That has just been sent out in the minutes of the meeting they had.

I would have thought the community is responsible for their upkeep and insurance, but the point is we dont know or nor it seems does El Presidente!

Patricia, when you say "planters", do you mean a fixed part of the fabric of the building, or separate moveable containers like plant pots ?

Who has been paying for the upkeep and insurance for the planters? I am assuming it came out of the community charges, i have no experience of community living so I'm just guessing..anyway if the cost of the upkeep of the planters has been coming out of the community charges then the residents should be expecting to pay a little less but i don't suppose it works like that..I think if your friend isn't happy about being made responsible for the planter then she should request they remove it..It does however seem quite strange that after all this time that they are now making residents responsible, perhaps the residents should all get together and ask for an explanation.
