Splitting land

Splitting land

Can anyone help, a friend of ours has more land than she can handle, and wants to split into parcels of 2,500x3, she wants to know a approx cost for the legal side and how and who to approach.
she lives in a community of 40 other houses on land. Any advice I can pass on.

if it is rustic land she cannot segregate to these sizes in the property register, the only thing she could do is split it in private contracts, but the buyers would not have escritura publica

The only way to segregate rural land so that each owner has an escritura is to use a process known as pro indiviso. It is not illegal but is highly undesirable.

Beachcomber, you say she cannot segregate it into these sizes if it is rustic land. What is the minimum size?

Minimum size for segregation is 50.000m2 as the segregated bits should be 25.000m2 on rural land. Smaller rural plots would have been segregated before the new law....but in the future these laws could change again....who knows.

I think the minimum now is 30.000m2, so you need at least 60.000+ to be able to segregate, even with 60000m2 you need a segregacion licence which isn´t easy to get !!

Seems its gone up again then, a couple of years back it was 25.000m2
