Non resident property seller - taxes?

Postby Jool » Wed Oct 07, 2009 8:46 pm

If you are an official non resident in Spain and you sell your apartment how and when do you pay your capital gains tax?

Does that and the plus valia to the town hall also have to be paid within one month of Notary signing as per the Registry fees and transmission taxes, or is there a different timescale for this? If what is it?

Which tax form needs to be completed for the CGT........

Be Spanish...........If after adding up all your expenses for buying and selling the apartment ¨create¨ some invoices for refurbishment.

The purchaser has one month from the date of signing of the escritura in which to pay the retention made from the seller and the seller then has three months from that date to submit his capital gains tax declaration which is made on form 212.
