Tax Declaration

Hi Any advice much appreciated.
Due to illness of a family member in the uk I have not
lived in Spain for the last 5 years.
I have a property now vacant and for those 5 years I have
come over 6 weeks per year-2 weeks at a time- to check on
things.
I still have a resident account with La Caixa bank and transfer about
100 euros per month to it to cover utility bills,insurance,etc.
I just arrived yesterday for 2 weeks and found a letter from La Caixa
dated 8/1 saying due to money laundering regs they need more information
on me i.e. “form 036 tax declaration and documents accrediting your economic
activity(income tax return and VAT tax return)”
The letter says if I do not provide this by 12/2 they will suspend my account and
ATM withdrawals!
I am retired on a UK pension and as I said for the last 5 years not living in Spain
so not economically active here.
How can I prevent them suspending my account?

I guess you should go in and talk to them. Explain you arent a resident anymore. ( did you ever file the form to say you were leaving spain?) Maybe show evidence of been a uk/resident tax resident

I would pm beachcomber asap for the correct advice. You don’t have much time and he is red hot on this type of problem.

Is this anything to do with the change in law a few years back. I remember my credit card company asking me for certain details otherwise they would have to suspend my account. I can't remember exactly what they were asking for but they were quire insistent

We have just received the money laundering letter from la Caixa. Same deadline 12th Feb. Interestingly it was in English.

We have to take in our Spanish tax returns to prove our economic activity.

I wonder if ours was triggered by UK banks/building socs chasing for our tax situation for old/ dormant accounts with a few quid in them.

We had a similar letter from LaCaixa (KYC - Know Your Customer) asking for information including the tax return which, as non-residents we do not have. We visited our local branch where the English speaking assistant entered all the information he could. This included a copy of a passport in place of the requested certificate of EU citizenship/residencia. He was a bit unsure about whether 'the system' would accept this but promised to contact us in the event of any problems. We've heard no more and so assume that the account has been cleared.

It will be due to money laundering regulations.

Take your UK bank book showing your pension payments, or the letter from the dwp that you got saying how much you will be getting ?

Was there ever a definitive answer on this?
Have received the same letter and also visited bank with my Passport details.
What was beachcombers advice?

Well we went to our gestor first and had 036 form printed off. They were "surprised that they had never given us it". Then they printed us a request for a digital signature which we took to the town hall to have fulfilled. Then to the bank to show this mountain of paperwork. The clerk filled in an online form and said everything is now OK. When we got home there was an Email from LaCaixa to say everything was fine. Of course today is the 12th so I half expect the account to be suspended anyway this being Spain. If I don't come back assume it is working fine!
