Holiday rental

This is a hypothetical question..if I was to buy a rural property and decided to rent it out as a holiday rental during the summer while I was away what do I need to do in order to have a license? Can anyone get one? Are there criteria to meet?

Hola

In the Cádiz area there are now inspections of the property - the inspector has a long list
directory of local information, emergency phone numbers, and a 24 hour phone number for the tenant if there are problems.
You must have a tourist plate outside
You must have a medical kit, fire extinguisher with signage, a complaints book and a yearly price list.
Drinkable water, and lots more things that off the top of my head i can't remember

And you need a license number which must be on Air BnB adverts. Nothing like the old days but doable if you want the extra work needed.

I did this a couple of years ago in the Malaga area. It was very straightforward - complaints book, fire extinguisher, first aid box and a lab based water test. They gave notice of the inspection and all very efficient.

What is the Spanish legal difference between a holiday let and a long term let (where presumably there are fewer onerous conditions)? For example does the property have to be let to the same person for say 3 moths or longer?

Make sure its got a Licence of First Ocupation. Any rural property over about 30 years old wont have one, as they didn't exist, and you have the delights of the DAFO process to go through - a joyful 6 months or so for an old rural property.

The property will come with the certificate DAFO, I was wondering if its just a case of applying for the papers for tourism licence or can it be refused because of location maybe?

Theres a rural licence which is different and has different requirements than one in a town

From what ive read (probably B.S!!) It just depends on the contract you sign with them. Ie a seasonal let contract can be for any amount of time but isnt covered by the longterm let rules.

I just been given this list - it is still work in progress - but is as up to date as possible. This year in this area the inspector has a properly produced "tick list" and is inspecting every property

INSPECTOR CHECKLIST

1) A practicable entry path for tourist vehicles, or easy transportation to accommodation
2) It has distinctive official plate of “Housing Turistica” de “Alojamiento Rural”
3) It has a Claims Book
4) It has a book of local information
5) Formal contract and access to the Rural Housing information including: -
 name of the person or business entity;
 Registration number in the Tourism Register of Andalucia;
 the number of people who will occupy it;
 the date & time of entry and departure,
 the total price of the stay;
 the telephone number for any query.
6) ??? Travel Entry Part ?
7) Emergency phone number for immediately attention (24 hours)
8) A price list in a visible place
9) N.B. the maximum capacity is 20 people for any licence.
10) The house has drinking water (with a laboratory certification) and deposit reservoir with capacity greater than 200 Litres per day if the supply is not mains fed.
11) Rubbish disposal service (withdrawal by own means or municipal collection)
12) Accredited treatment of wastewater

LIVING ROOM and ROOMS
1. They have heating available from October to April (both inclusive) to raise the temperature to a minimum of 19 C
2. It has evacuation plans and safety record (recommended)
3. There is a First Aid kit available
4. Minimum area of the living room 12m2
5. It is sufficiently furnished and equipped with appliances and ensures in function of its capacity, including Window security system
6. Bedding, (minimum 1 reposition) and house made up in general
7. Minimum area of 7m2 (single) and 10m2 (double) 4m2 for each additional space. Exclude any terrace and bathroom areas
8. Must be equipped with bedside tables and single or double beds. No foam or wool mattresses.
9. Wardrobe for every four people
10. Minimum height of 2m (in case of attic, min 70% higher than said height);
11. Direct exterior or adequately ventilated patios (forced non-ventilating)
12. Access to common elements and not through another room
13. Matches the number of places registered with those offered
14. Does not provide complementary services (breakfasts, meals, etc.)


Kitchen Equipment
 a hob;
 An oven or microwave;
 A fridge
 A washing machine;
 Crockery, cutlery, glassware and kitchen utensils and cleaning equipment
 Sink and drain with hot and cold running water
 Direct or forced ventilation
Other items
1. At least one bathroom (sink, toilet and a shower or bath) for every 6 people, with hot and cold water. It should be located in the same building as the rooms.
2. Equipped with mirror, towel rack and shelf
3. The available hot water flow ensures the toilet, even shower, to all users over 1 hour
4. There must be suitable bathroom linen for the number of occupants (minimum 2 lots per person per week)
5. Direct or forced ventilation

Is that list for rural properties dxf? It makes me think that the rental properties in our valley do not have a licence as there's no drinking water here. In fact the places we rent when we go away in Spain do not meet all those requirements but are on airbnb. We still have to buy bottled water as we've been told the water is not ideal for drinking!

This is for short term holiday rentals as under the 2018 act - applies to the Cádiz area - i don't know how other areas are applying the law

No A/C required yet; you have to have a window to open and i believe fans to put on. But as I said, it's early days, this coming year is the third year since the regulations came in

Friends who rented through a Brit agency had to have aircon and uk tv/internet before they would list them, and that was 4 or 5 years ago.
