LAW CLARIFICATION - Marihuana

Postby Acen » Tue Nov 02, 2010 10:56 am

Just read on Typical Spanish news

"Under Spanish law the growth of marihuana is prohibited ‘from the first plant’, with punishment ranging from a simple fine to 12 years in prison in the case of trafficking."

Can someone clarify what "from the first plant" means as I though it was decriminallised to have 2 adult plants per adult per house hold.

Any thoughts???

Friend moved into her holiday home to find neighbours both sides had loads of plants growing  When the removal men arrived and saw the plants they lopped off the top of some, they said they could make ´good money down on the coast´

Likewise around the villages hereabouts. You even see it growing on the balconies of village houses.

Our very respectable Spanish neighbours had a break in - well thieves entered the garden and the only thing taken was the two 'pot' plants in the garden. Not sure if they called the police though!!!!!!! :shh:

This is the point of starting this thred, would your neighbours been prosecuted for two plants for personal consumption. They law in spain is "against public health" which my interpretation is drug dealing!!!!!

Don't know if it's legal, but along with a lot of things up this way provided you keep it quiet, don't upset anyone and keep it small nothing gets done about it. I will, however, ask some Spanish friends today and let you know.

I think the ""from the first plant" bit was a direct translation from this article, but the police are reminding people that even the cultivation of one plant is illegal.
Not surprisingly, the police are getting their information from tip offs from neighbours, and they reckon that the crisis is causing a boom in domestic cultivation of these plants. I get the impression that if someone gives the police a tip off, they have to act, but otherwise they probably wouldn't bother. And whatever your Spanish neighbours tell you, it's illegal!

Well I asked the neighbours and they said that ONE plant for your own use and grown inside the house was probably OK though not strictly legal, but anything more was a big NO NO. And I was right, my other neighbours didn't report the loss of their tow plantd to the police!!!!! :shh:

I have two plants on my balcony, cared for while I'm away by my Dutch neighbour who naturally gets a cut, whats interesting is that our handyman needed to work on our balcony last year and after checking them over advised me to move them to a new position, this guys in his sixties !!

Whats wrong with being sixty something! It normally means you have more experience in things plus people have been using weed for 1000's of years & does not come with an upper age limit.
