Sorry if this topic puts anyone off their breakfast.

If I decide to get some help with my tax return, is it better to use a laywer, gestor, or accountant?

My tax affairs should be relatively uncomplicated.

We have been advised to use a "Fiscal Asessor" which I'm told is the spanish equivalent of an accountant, if this helps.

From my short experience here, on this site, I would probably enlist the help of "Beachcomber" he seems to be up to speed on most things legal and technical in Spain.

The best, and cheapest, option is to go to your local tax office and get them to help you fill in the forms online.

If your tax situation is more complicated then a good gestor will sort it for you but some charge 120 euros per person.

Once you have done it the first time it is pretty easy to download the Renta program and do it yourself online the next time.

Yes, I agree with Sid. I do my own tax returns and also those of my wife who is self employed but I wouldn't want to be responsible for anyone else's.

form 214

Hi
This tax form 214, it this the form we fill in, whether we are letting our property out or not, and not resident in Spain, also when would it start and finish, we have own our house for just 1 year now, we did pay the IBA in September, so after we fill this in and return, have we paid all taxes due for this year, also how do we know when our car tax id due?

The non-resident taxes can be paid on a form 214 as long as you own one property only and has to be submitted during the year following that in which it becomes due.

So if you bought your property after January 1st 2005 you need to submit the form any time up until the 31st December this year.

The due date for the car tax varies with each municipality. You will need to check with your local Town Hall. You can put this on standing order along with your IBI.

Thanks Beachcomber that's a great help, although I still don't understand the form, if i go to the tax office armed with my other payment slip, i take it they will give me the sticky labels and help me out.
When I was trying to pay the other tax the man at the town hall, thought I was strange, that I was worried about paying it, probably my pigeon Spanish and the fact that nobody speaks any English in there, but we got there in the end, I have to say they are getting used to me now, after doing things on my own, building license , tax etc, I am sure I wouldn't get the same reception in my local town in the UK,

The non-resident taxes are nothing to do with the local town hall which is probably why they didn't know what you were talking about especially if there a few foreigners in your area.

In order to get your sticky labels you need to take your NIE sheet (the one issued by the police) and escritura with you to the tax office and register. If you want help filling in your form 214 you will need to show your escritura and also your IBI receipt for 2005.

As with many aspects of Spanish life this is a bit of a grey area.

For some purposes the receipt for your application for residencia is sufficient but until your residencia is issued you are not actually classed as a resident.

Bear in mind that even if your residence permit is issued later this year the tax submission during this period will be for the financial year of 2005 when you were definitely a non-resident.

Assuming you finally get your residencia sometime this year you will submit your tax return as a resident in 2007 for the financial year of 2006 but this has to be done between the 20th May and the 30th June whereas a non-resident has the whole year in which to do it.

Last year was the first full year for which I expect to have to pay Spanish tax on my UK State Pension. Reading the above posts I am hoping to have a shot at completing the declaration myself and taking it into the local tax office here in Alora. I am registered there and am aware that I need bar code labels to attach to the form.
Looking at the web site reached from Beachcombers link above, I´m not clear which Modelo I should use as a Resident with just the State Pension income to declare. Grateful if Beachcomber or El Cid could advise please.

The only way you can complete the declaration yourself is by using the PADRE program which you can download from the AEAT site. The forms it prints will have the barcodes on them.

If you go to the tax office they will do it for you on their computer using the same program. You just take the forms to the bank to pay the tax.

Sid, many thanks for the speedy response. I downloaded the PADRE programme but I can´t make head or tail of it so, I will take my information to the tax office and get them to do the necessary as you suggest. Just a further point, I recall someone asking what rate of exchange should be used, can´t find the posts, do you know please? Thanks.

The average rate for the year is 1.25.

There is no reason why you cannot use the rate on the day you received your pension. All you will be asked to provide at the tax office is your total income in Euros.

They do not normally require proof of income or details of exactly what it was. It is a self assessment system and it is up to you to make a declaration. How you arrive at it would only ever be questioned in the event of a tax investigation.

Save yourself the hassle and let a gestor do it. Our gestor charges €35 and saves us hundreds.
