Power of attorney

My wife has vascular dementia is is losing her ability to speak and her memory.
She has forgotten that I am her husband.
I would like to get the Power of attorney so that I can manage all her financial and medical affairs etc.
We are both fully resident in Spain and jointly own our house and have a joint bank account here in Spain.
Don't have any assets in the UK.
Had a look on Google but solicitors want €400- 600
Also, see reference that we can do it ourselves at a notary for about €60.
Is this correct? If so, can anybody recommend a notary in the Nerja to Rincon de la Victoria area? Preferably one who speaks English.
There is very little chance of my wife being able to understand questions in Spanish and no chance of replying in Spanish.

So sorry to hear about Mrs H. We have used this notary for our wills and more lately notarising copies of our proofs of ID.

There are English speaking girls in the office and Juan speaks English too. I guess the price you found is about right as our wills (although a few years back) were only 38€ and notarising proofs of ID were about 3,50€ each. Many times cheaper than using an abogado or even a gestoria I would think.

Sad news Gerry - you may need to go the solicitor route as a power of attorney may only normally be granted when the person is fully aware of what they are doing and can communicate this. Hope you have not left things too late, and you have my sympathy.

First i hope you are ok Gerry in what must be a very stressful and sad time for you. Have you tried Citizens advice? I wish i could add something which would be more helpful to you.

I would try the Notary in Velez Malaga but pay a good interpreter to be with you, hopefully you have not left it to late. I did this with my late Mother several years ago and the cost was approx 50 euro.

My sympathy too Gerry, I went through this with my mother, I found the "Who are you" stage and beyond very taxing. I know what you are feeling.

In the UK the subject only needs to show that they understand and are in agreement at the time of taking out the power of attorney, even if there has been a diagnosis of dementia - not sure if it would be the same in Spain, but it may come down to having the right notary…

Good luck Gerry. See what you can find out on the phone. When I rang about the notarising the girl I spoke to didn't speak English although she said her colleague did. I managed OK in Spanish, but yours is a complicated situation so I hope you manage to get hold of the English speaker. Juan spoke good English when he dealt with our wills.

Just got back from the notary.
Now have Power of attorney for all of my wife's affairs.

Well done Gerry. What was involved and what was the cost?

Needed someone to translate the document for us as our Spanish is not very good.
Our passports and TIE cards were checked.
The Notary asked my wife, in English, if the address was correct. presumably to establish her level of understanding and awareness.
Then he needed her signature, the translator's signature, and his signature on the document.
The official document was then printed.
Total cost € 101.91 and about an hour and a half of our time, most of which was hanging around waiting for paperwork to be printed and some amendments made.
