If you are on holiday in Andalucia or are a local resident, your rights are the same. If you have a complaint because you feel that a Andalucian business product or service has not met your expectations, what can you do?

If an initial verbal complaint does not meet with your satisfaction, you should ask the establishment for their 'Hoja de Reclamaciones' (complaint sheet) which all business must have and provide on request. Sometimes just asking for this helps resolve the issue. More about the complaint book>

 

 

As a consumer in Andalucia you will find at your disposal dedicated government offices designed to advise you regarding your rights and responsibilities. There are also numerous private consumer organisations that operate at both national and regional level.

Town Hall The town hall will have a department or office for the consumer locally called Oficina del Consumidor. More>

Junta de Andalucia The Junta de Andalucia offer info in Spanish on their website regarding Consumer complaints (Spanish). They also have a specialised website on consumer issues inter the title Consumo Responde (Spanish)

Defensor del Pueblo The 'Defensor del Pueblo (Ombudsman) is the High Commissioner of the Andalucia parliament responsible for defending the fundamental rights and public liberties of citizens by supervising the activity of the Spanish public administrations. The Ombudsman is elected by the Congress and the Senate with a five-year mandate. Any citizen can go to the Ombudsman and request a (free of charge) investigation of any alleged irregular action by the public administration or its agents. Defensor del Pueblo.

If you wish to take the complaint further, you will need the services of a Spanish lawyer. He or she will initially ask for details of the written contracts to establish who are the contract parties (as oposed to agents) and which courts would be juristrict.
